1. DEFINITIONS
• “Account” shall mean the account You create upon registration on the Website to access the Services.
• “Law” shall mean all applicable statutes, ordinances, rules, regulations, and orders of any governmental authority in India.
• “Products” shall mean the range of dry snack,beverageproducts offered for sale by RDS on the Website.
• “User” shall mean any person competent to enter into a contract under the Indian Contract Act, 1872, who registers for an Account on the Website. Persons below the age of 18 years are not eligible to use the Website.
2. OUR PRODUCTS AND SERVICES
We own and operate the Website, offering for sale a range of dry snack and tea Products. All product descriptions and pricing are subject to change at any time without notice at our sole discretion. We reserve the right to limit the sales or quantities of any Products we offer and to discontinue any Product at any time.
3. USER REGISTRATION
• Account Creation: To purchase any Products from the Website, You must create an Account by providing accurate and complete personal information, including your name, email ID, and delivery address. There is no option to purchase products as a guest user; everyone must sign up to proceed with a purchase.
• No Third-Party Login: We do not offer an option to sign up or log in through integrated third-party services such as Google or Facebook.
• Password & Security: You are responsible for maintaining the confidentiality of your password and Account. You agree to notify Us immediately of any unauthorized use of Your Account. We reserve the right to suspend or terminate Your Account if We believe it is being used in a manner that violates these Terms.
• Account Deletion: In compliance with applicable laws, You may request to delete Your Account at any time by contacting our Grievance Officer. Upon such a request, We will delete Your personal data, subject to any statutory data retention requirements.
4. PRICING AND PAYMENT POLICY
• Pricing: The price for each Product shall be displayed on the Website in Indian Rupees. The total price, including applicable taxes and delivery charges, will be displayed in your shopping cart before checkout.
• Payment Methods: We accept payments via online modes, including credit cards, debit cards, net banking, and UPI, processed through our designated online payment gateway service providers. As of now, we do not offer a Cash on Delivery (COD) option.
• Payment Security: We do not store your credit card information. All transactions are processed through a secure third-party payment gateway. Any loss of information stored by the payment gateway will be solely a matter between You and the provider; We shall not be liable for any such losses.
• Order Confirmation: An order is confirmed only upon receipt of full payment. We will not be liable for any payment failures due to technical errors, connectivity issues, or incorrect credentials.
5. SHIPPING AND DELIVERY POLICY
• Service Area: We currently do not provide international shipping. Our delivery services are limited to addresses within India.
• Delivery Time: The time taken to deliver a product depends on the location. For deliveries within the southern region of Tamil Nadu, it will likely be within 10 working days. Delivery timelines provided are approximate and not guaranteed.
• Delivery Partners: Products are delivered through third-party courier partners. For local customers, we may deliver the products directly. We shall not be liable for any delays caused by our third-party logistics partners.
• Shipping Charges: We accept orders of 500 grams and above only. Shipping charges are extra and are calculated based on the weight of the order. We offer free delivery for orders above 1 kg.
• Correct Address: You are responsible for providing a correct and complete delivery address. We are not liable for delivery failures arising from an incorrect address provided by You.
6. CANCELLATION POLICY
You can cancel an order within one (1) day of placing it, provided it has not yet been shipped. Once an order is shipped, it cannot be canceled for any reason. Upon successful cancellation, any amount paid will be refunded to the original payment source within 10 working days.
7. RETURNS, REFUNDS, AND EXCHANGE POLICY
• Grounds for Return: Products can be returned under the following conditions:
o The packaging seal is already opened or torn upon delivery.
o There is a foul smell from the product.
o The product is past its expiry date.
o Note: Slight folding of the outer box will not be accepted as a ground for return, as the boxes are fragile and prone to folds during shipping.
• Return Process:
o You must raise a return complaint within three (3) days from the date of delivery.
o To initiate a return, you must email a picture and video of the defective product to rds.official.2025@gmail.com, along with your order number and phone number.
o We will verify the defect and process the return. We will bear the cost of return shipping for verified claims.
• Refunds: Once we verify that the returned product is defective, a refund will be processed within 10 working days to your original mode of payment.
• Exchange: A product can be exchanged only if it does not match the order you placed.
• Resolution: For defective products weighing less than 1 kg, we will replace the product within 10 working days. For defective products weighing more than 1 kg, we will process a return and refund within 10 working days.
8. USER CONDUCT
You agree not to use the Website to engage in any activity that is unlawful, fraudulent, or harmful to Us or any other person. You shall not impersonate any person, infringe on any intellectual property rights, or use the Website for any commercial resale purposes.
9. INTELLECTUAL PROPERTY
All content on this Website, including text, graphics, logos, images, and software, is the property of RDS or its content suppliers and is protected by Indian and international copyright laws. The “RDS DRY SNACKS” & “RANT” name and logo are trademarks of RDS AGENCY. You shall not use our trademarks or copyrighted content without our express written permission.
10. DISCLAIMER OF WARRANTIES AND LIMITATION OF LIABILITY
The Website and all Products are provided on an “as is” basis. We make no warranties, express or implied, regarding the accuracy, completeness, or fitness for a particular purpose of the Products or Services. Our total aggregate liability under these Terms shall not exceed the total amount paid by You for the specific Product on which the claim arose.
You agree to indemnify and hold RDS and its affiliates harmless from any losses, damages, or costs arising from Your use of the Website or Your violation of these Terms of Use.
12. GOVERNING LAW AND JURISDICTION
These Terms of Use shall be governed by the laws of India. You agree that the courts of Chennai, Tamil Nadu, shall have exclusive jurisdiction to settle any dispute arising out of these Terms.
